These Terms of Service govern your use of The Burrow Bookstore’s website and any purchase made through it. Throughout these Terms, “we,” “us,” and “our” refer to The Burrow Bookstore. “You” and “your” refer to website visitors and customers.

By visiting our website, placing an order, or using any feature or service available through the website, you agree to these Terms of Service and the policies referenced within them. If you do not agree, please do not use the website or complete a purchase.

1. Eligibility

By using this website, you confirm that you are legally able to enter into a binding agreement. If you are under the age of majority in your state, you may use the website only with the permission and supervision of a parent or legal guardian.

You may not use our website or products for an unlawful or unauthorized purpose.

2. Store Policies

Our Shipping and Local Pickup Policy, Return and Refund Policy, and Privacy Policy are incorporated into these Terms of Service and form part of the agreement between you and The Burrow Bookstore.

By completing a purchase, you acknowledge that you have had an opportunity to review and agree to these policies.

If a product listing contains terms that are more specific than a general store policy, the terms stated in the product listing will apply to that product.

3. Products and Product Descriptions

We make every reasonable effort to describe and photograph our products accurately. However, colors and other details may appear differently depending on your screen, device, lighting, or display settings.

Many of our books and other products are used, vintage, handmade, customized, limited in quantity, or otherwise unique. Used and vintage items may show ordinary signs of age or previous ownership. Known flaws that materially affect an item’s condition will be disclosed whenever reasonably possible.

Measurements and condition descriptions are provided in good faith and may involve reasonable judgment. Slight variations in handmade, personalized, or custom products are not necessarily defects.

4. Availability and Inventory

All products are subject to availability. Because we sell products both online and in our physical store, an item may occasionally sell in one location before our inventory system updates.

Placing an order does not guarantee acceptance or availability. If an item is unavailable, we may cancel the affected item or order and issue an appropriate refund.

We may limit the quantity of any product available to a customer, household, geographic area, or order.

5. Prices and Errors

Prices, descriptions, promotions, availability, and other information may be changed at any time without notice.

We reserve the right to correct typographical errors, pricing mistakes, inaccurate descriptions, inventory errors, or other omissions. If an error affects an order that has already been placed, we may contact you for instructions or cancel and refund the affected item or order.

We will not intentionally charge a different price after an order has been accepted. If we cannot honor a price because of a genuine mistake, we will notify you and provide the option to proceed at the correct price or receive a refund.

6. Orders and Payment

You agree to provide current, complete, and accurate billing, shipping, pickup, payment, and contact information.

You authorize us and our payment processors to charge the payment method selected at checkout for the order total, including applicable taxes, shipping charges, and other amounts disclosed before purchase.

An order confirmation acknowledges that we received your order. It does not guarantee that every item will be available or that the order has been accepted for fulfillment.

We may refuse, limit, or cancel an order when reasonably necessary, including orders involving suspected fraud, unauthorized payment activity, pricing or inventory errors, resale activity, policy abuse, or violations of these Terms.

If we cancel an order after payment has been collected, we will issue any refund required under the circumstances and our published policies.

7. Shipping

Shipping methods, processing times, delivery estimates, address requirements, carrier delays, missing packages, damaged shipments, and related matters are governed by our Shipping and Local Pickup Policy.

Carrier delivery dates are estimates unless we expressly state otherwise. We are not responsible for delays caused by carriers, weather, emergencies, transportation interruptions, incorrect customer-provided information, or other circumstances outside our reasonable control.

8. Local Pickup Orders

Customers who select local pickup agree to the complete Local Pickup provisions contained in our Shipping and Local Pickup Policy.

Local pickup orders must be collected within 30 calendar days after the first ready-for-pickup notification is sent. Orders not collected within that period may be canceled and refunded to the original payment method, less any documented, nonrefundable payment-processing or transaction fees incurred by The Burrow Bookstore in connection with the purchase.

Once the refund is issued, ownership of the merchandise returns to The Burrow Bookstore. It may then be returned to inventory, donated, or disposed of at our discretion.

Customers who need additional time must contact us before the deadline and receive written approval for an extension.

By selecting local pickup and completing the purchase, you specifically acknowledge and agree to these conditions.

9. Returns, Exchanges, Refunds, and Cancellations

Returns, exchanges, refunds, order changes, and cancellations are governed by our Return and Refund Policy and any additional conditions disclosed in the applicable product listing.

Certain products—including personalized, custom-made, special-order, final-sale, clearance, digital, or otherwise identified items—may not be eligible for return, exchange, or cancellation.

Nothing in these Terms eliminates any right or remedy that cannot legally be waived.

10. Personalized and Custom Products

Customers are responsible for reviewing all names, dates, sizes, colors, wording, images, personalization details, and other information submitted with an order.

We are not responsible for errors contained in information approved or supplied by the customer. Personalized or custom work may begin shortly after an order is placed, and changes or cancellations may not be possible once work has begun or materials have been ordered.

Customers who provide text, photographs, logos, graphics, or other materials represent that they have permission to use those materials and authorize us to use them solely as necessary to complete the order.

We may decline any requested customization that we reasonably believe is unlawful, infringing, hateful, threatening, deceptive, or otherwise inappropriate.

11. Gift Cards, Promotions, and Discounts

Gift cards, promotional codes, discounts, and special offers are subject to any additional terms disclosed when they are issued or advertised.

Unless otherwise stated, promotions cannot be combined, applied retroactively, redeemed for cash, or used after their expiration date. Discounts have no cash value.

Gift cards are also subject to applicable law and any terms provided with the gift card.

12. Reviews and Customer Submissions

If you submit a review, photograph, comment, suggestion, testimonial, or other content to us, you confirm that the submission is truthful, lawful, and does not violate another person’s rights.

You grant The Burrow Bookstore permission to display, reproduce, and share content that you voluntarily submit for publication or promotional use, including on our website and social media, unless we agree otherwise in writing.

We may remove content that is unlawful, abusive, deceptive, unrelated, infringing, or otherwise inappropriate. We are not obligated to publish every submission.

13. Intellectual Property

The content on this website—including our original text, photographs, graphics, branding, logos, designs, page layouts, and other materials—is owned by or licensed to The Burrow Bookstore and is protected by applicable intellectual-property laws.

You may browse the website and make purchases for personal use. You may not copy, reproduce, republish, distribute, sell, modify, scrape, or commercially exploit our website content without prior written permission.

Third-party names, book covers, trademarks, characters, artwork, and other materials remain the property of their respective owners.

14. Third-Party Services and Links

Our website may use or link to services operated by third parties, including Shopify, payment processors, shipping carriers, social-media platforms, and other websites.

We do not control every third-party service and are not responsible for its separate content, availability, security practices, or policies. Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

15. Website Availability and Prohibited Conduct

We may modify, suspend, restrict, or discontinue any portion of the website when reasonably necessary for maintenance, security, business operations, or other legitimate purposes.

You may not:

• Attempt to gain unauthorized access to the website, customer accounts, or connected systems.

• Upload or transmit malicious code.

• Interfere with the security or operation of the website.

These disclaimers do not limit any warranty, right, or protection that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, The Burrow Bookstore will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, delays outside our reasonable control, or the purchase or use of our products.

We will make reasonable efforts to communicate material delays and fulfill affected obligations when circumstances allow.

19. Governing Law

These Terms and any separate agreement through which we provide products or services are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be handled by a court of competent jurisdiction as permitted by applicable law.

Before filing a formal claim, we encourage you to contact us and give us a reasonable opportunity to resolve the concern.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or removed as necessary. The remaining provisions will continue in effect.

21. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

22. Entire Agreement

These Terms, together with the policies and product-specific conditions referenced in them, constitute the agreement between you and The Burrow Bookstore regarding your use of the website and purchases made through it.

Any ambiguity will not automatically be interpreted against either party merely because one party prepared the language.

23. Changes to These Terms

We may update these Terms to reflect changes in our services, policies, business practices, or legal obligations.
